- "Zone (network)" means a category of the network to which a server is connected, and includes the types indicated by the Company on the order screen, such as the General Zone and the Security Zone.
- "Management Console" means the web interface (Dashboard) through which a Member can check and manage server status, order and payment history, expiry dates, traffic usage, etc.
Article 4 (Posting and Amendment of the Terms)
- The Company posts the contents of these Terms at the bottom of the Service screen or on a linked screen so that Members can easily review them.
- The Company may amend these Terms to the extent that doing so does not violate applicable laws, and in the event of an amendment, will announce the effective date of and the reasons for the amendment from 7 days before the effective date. For amendments that are unfavorable to Members or material, the announcement will be made from 30 days before the effective date.
- If a Member continues to use the Service after the effective date of the amended Terms, the Company may deem the Member to have agreed to the amendments. A Member who does not agree to the amendments may stop using the Service and withdraw from membership.
Article 5 (Membership Registration and Account Management)
- Membership registration is established when a user enters accurate information, agrees to these Terms and the Privacy Policy, and then completes verification of the email address used to register.
- Persons under the age of 14 may not register as Members, and users must confirm upon registration that they are 14 years of age or older. Payments for paid services by minor Members are governed by the Payment Terms.
- Members must keep their account information up to date and are responsible for managing their accounts and passwords. The Company provides a 2-step verification (OTP) feature to protect accounts and recommends that Members use it.
- Members must not misappropriate the information of others or register false information, and the Company may reject a registration application made in such a manner or terminate the service agreement after the fact.
Article 6 (Content and Provision of the Service)
- The Company provides Members with functions for ordering and paying for Server Products, provisioning, renewal, purchasing additional traffic, checking server status, expiry dates and traffic usage, viewing order history, and customer support.
- The Company may inform Members by email of matters necessary for using the Service, such as upcoming expiry and traffic usage, and provides information on how to use the Service and on the status of outages through the User guides, FAQ and Service status pages.
- Server provisioning is processed after payment is completed in accordance with the operating procedures of the Company or the linked infrastructure, and the time of provisioning may vary depending on system maintenance, stock availability and verification procedures.
- To provide the Service stably, the Company may take measures necessary for operations, such as maintenance, capacity expansion and outage response, and as a rule gives prior notice of any scheduled work.
- Where there are reasons such as maintaining service quality, responding to security issues, policy changes or changes in the operating conditions of the linked infrastructure, the Company may change or discontinue part of the configuration of the Service, the method of provision, the products for sale, the operating system options, the infrastructure regions (in Korea and overseas) and additional options. As a rule, even if sales of a product are discontinued, this does not affect the renewal of servers already in use.
Article 7 (Orders, Provisioning and Renewal)
- Members may select and order Server Products in accordance with the procedures provided by the Company.
- Even after an order is completed, provisioning may be put on hold where payment approval, verification of abnormal transactions or operational review is required.
- The operating system and the Zone (network) are determined at the time the server is provisioned and cannot be changed after provisioning. The specifications of a server in use also cannot be changed; therefore, if a different operating system, Zone or specification is needed, the Member must order a new server and migrate the data themselves.
- For products with a fixed service period, if the renewal payment is not made before the expiry date, use may be restricted or terminated, and data recovery after termination is not guaranteed.
- If the content of a Member's order is contrary to the Service policies, technical constraints, legal risks or operational stability, the Company may decline to approve the order or discontinue the service concerned even after provisioning.
- A contract for a Dedicated Server is formed when, after the Company receives the Member's purchase inquiry, the Member agrees to the quote and conditions provided by the Company and makes payment. If the individually negotiated conditions differ from these Terms, the individually negotiated conditions prevail.
Article 8 (Traffic and Network Use)
- The daily traffic allowance displayed on the order screen applies to Server Products, and the allowance is reset every day.
- Exceeding the daily allowance does not cause the server to be suspended, but the network speed may be limited for the remainder of that day. Members may purchase additional traffic in the Management Console.
- For Zones separately indicated by the Company, such as the Security Zone, fees are determined according to the traffic volume set by the Member at the time of ordering, and additional traffic may be purchased if it is insufficient.
- If a Member's server is under attack or generates traffic that harms the stability of other Members or the Company's infrastructure, the Company may temporarily restrict that server's network to protect the network.
- The General Zone (KT-A and KT-B) is a standard network that does not provide DDoS protection. If another server using the same network comes under attack, network protection measures may cause latency or temporary disconnections. For services at risk of attack, such as game servers open to the public, the Security Zone can be selected when ordering.
Article 9 (Data Management and Backup Responsibility)
- Members are responsible for managing all data, applications, account settings and access rights that they store, install or operate within the Service.
- The Company does not back up data on servers. Since access to data may be temporarily restricted for outage response or operational needs, Members must maintain their own backup system in preparation for this.
- Unless there is willful misconduct or gross negligence on the part of the Company, the Company is not liable for the loss, damage, deletion or unrecoverable state of data that the Member has not separately backed up.
Article 10 (Obligations of Members)
- Members must comply with applicable laws, these Terms, the Service usage guidelines and the Company's notices.
- Members must not post illegal information, infringe the rights of others, cause abnormal traffic or engage in acts that interfere with the operation of the Service.
- Members are responsible for managing the data and programs on the servers they operate, and must themselves carry out the necessary security measures, such as operating system updates, firewall configuration and password management.
- Members must not, without the Company's prior approval, resell or sublease the Service, transfer it without authorization, access the system by circumvention, send excessive automated requests or engage in acts that place a burden on the Company's infrastructure.
Article 11 (Restriction of Service Use and Termination of Agreement)
- If a Member violates laws or these Terms or infringes the rights of others, the Company may, depending on the seriousness of the matter, restrict the Member's use of the Service after prior notice or, in urgent cases, without prior notice.
- Members may terminate the Service or withdraw from membership at any time; however, refunds for paid services that have already been provisioned or whose use has commenced are governed by the separate Payment Terms and applicable laws.
- If spamming, causing security breaches, distributing illegal content, attempting unauthorized access, excessive occupation of resources, fraudulent payment or identity theft is suspected, the Company may immediately take measures such as restricting access, blocking the network, reclaiming resources and terminating the agreement.
- Data transfer, provision of backups and separate technical support in connection with the restriction of use or termination of the agreement may not be provided under Company policy.
Article 12 (Damages and Disclaimer)
- If damage is caused to the Company or a third party for reasons attributable to a Member, the Member must resolve the matter at their own responsibility and expense and compensate the Company for any damage it has incurred.
- Unless there is willful misconduct or gross negligence on the part of the Company, the Company is not liable for service interruptions caused by reasons beyond the Company's reasonable control, such as natural disasters, power failures, failures of facilities-based telecommunications carriers or external linked systems (including infrastructure providers in Korea and overseas), and attacks by third parties such as DDoS attacks. Compensation and refunds for service interruptions caused by reasons attributable to the Company are governed by Articles 7 and 8 of the Payment Terms.
- The Company is not liable for leakage of account information, server configuration errors, failure to back up data, or loss of information posted or stored by the Member, where caused by reasons attributable to the Member.
- Even where the Company's liability is recognized, its scope may, to the extent permitted by applicable laws, be capped at the service fees actually paid by the Member for the most recent payment immediately before the problem occurred or during the most recent 1 month.
Article 13 (Notification)
The Company may give notice by methods such as email to the address registered by the Member, notifications on the Service screen (including pop-ups) and posts on the Notices page, and the Company is not responsible for any disadvantage arising from incorrect entry or failure to update Member information.
Article 14 (Governing Law and Jurisdiction)
These Terms are interpreted in accordance with the laws of the Republic of Korea, and if a dispute arises between the Company and a Member in connection with the use of the Service, the court having jurisdiction under applicable laws shall be the court of first instance. However, if the Member is a consumer residing outside Korea, the consumer protection provisions prescribed by applicable laws may apply preferentially.
